    Terms and Conditions

     

    1. About TrackFit

    TrackFit is a digital wellness platform that provides instructor-led fitness, mobility, stretching, and wellbeing sessions designed for professional drivers and related users. TrackFit does not provide medical advice, diagnosis, or treatment.


    2. Eligibility

    • You must be at least 18 years old to use the Platform. 
    • By using TrackFit, you confirm that you are legally capable of entering into a binding agreement. 
    • TrackFit is not intended for minors, and we do not knowingly allow users under 18. 


    3. Account Registration

    To access certain features, you may be required to create an account.

    You agree to:

    • Provide accurate and complete information 
    • Keep your login credentials secure 
    • Notify us immediately of unauthorized use of your account 

    You are responsible for all activity that occurs under your account.


    4. Platform Use & Acceptable Conduct

    You agree to use TrackFit:

    • Only for lawful purposes 
    • In accordance with these Terms and all applicable laws 
    • In a respectful and non-harmful manner 

    You may not:

    • Misuse the Platform or interfere with its operation 
    • Upload false, misleading, or harmful content 
    • Attempt unauthorized access to systems or data 
    • Harass, abuse, or endanger other users or instructors 

    TrackFit reserves the right to suspend or terminate accounts that violate these Terms.


    5. Health, Fitness & Medical Disclaimer

    TrackFit provides general fitness and wellbeing content only.

    You acknowledge and agree that:

    • TrackFit is not a medical service 
    • Sessions and content are not medical advice 
    • TrackFit does not diagnose, treat, or cure any condition 
    • You are responsible for assessing your own physical condition before participating 
    • You should consult a qualified healthcare professional before beginning any fitness program
       

    If you experience pain, dizziness, shortness of breath, or discomfort, you should stop immediately and seek medical advice.


    6. Instructor Services

    Instructors on TrackFit:

    • Are independent service providers, not employees 
    • Are responsible for their content and session delivery 
    • Do not provide medical diagnosis or treatment 

    TrackFit does not guarantee specific results from any instructor or session.


    7. Payments, Subscriptions & Revenue Sharing

    Users / Drivers

    • Certain services require payment or subscription 
    • Prices and packages are displayed before purchase 
    • Payments are processed via third-party providers (e.g., Stripe) 


    Instructors

    • Revenue generated through TrackFit sessions is shared 50% TrackFit / 50% Instructor, unless otherwise agreed in writing 
    • Payments are made according to TrackFit’s payout schedule 
    • Instructors are responsible for their own taxes and legal obligations 

    TrackFit reserves the right to update pricing, packages, or payment terms with notice.


    8. Cancellations, No-Shows & Refunds

    • Cancellation and refund rules may vary by session or package 
    • Missed sessions (“no-shows”) may not be refundable 
    • TrackFit may issue refunds at its discretion in exceptional cases 

    Details will be provided at the time of booking or purchase.


    9. Intellectual Property

    All content on TrackFit, including:

    • Text 
    • Logos 
    • Designs 
    • Software 
    • Platform features 

    is owned by or licensed to TrackFit and protected by intellectual property laws.

    Instructors grant TrackFit a non-exclusive license to host and display their submitted content for platform use.

    You may not copy, distribute, or exploit content without permission.


    10. Privacy

    Your use of TrackFit is subject to our Privacy Policy, which explains how we collect, use, and protect personal data. By using TrackFit, you consent to our data practices.


    11. Limitation of Liability

    To the fullest extent permitted by law:

    • TrackFit is not liable for injuries, losses, or damages arising from platform use 
    • Use of the Platform is at your own risk 
    • TrackFit is not responsible for third-party services or technical interruptions 

    TrackFit’s total liability, if any, shall not exceed the amount paid by you to TrackFit in the previous 12 months.


    12. Indemnification

    You agree to indemnify and hold harmless TrackFit from any claims, damages, or expenses arising from:

    • Your misuse of the Platform 
    • Violation of these Terms 
    • Violation of applicable laws 
    • Content you submit or actions you take on the Platform 


    13. Termination

    TrackFit may suspend or terminate your access:

    • For violation of these Terms 
    • For safety, legal, or operational reasons 
    • At its sole discretion, with or without notice 

    You may stop using the Platform at any time.


    14. Changes to These Terms

    TrackFit may update these Terms periodically.

    • Updated versions will be posted on the website 
    • Continued use of the Platform constitutes acceptance of updated Terms 


    15. Governing Law

    These Terms shall be governed by and interpreted in accordance with the laws of the applicable jurisdiction where TrackFit operates, without regard to conflict-of-law principles.

    Return and Refund Policy

     

    This Return and Refund Policy explains how refunds, cancellations, and returns are handled for services purchased through the TrackFit platform (“Platform”).

    By purchasing or using TrackFit services, you agree to this policy.


    1. General Policy

    TrackFit provides digital services, including live instructor-led sessions, wellness programs, and subscription-based packages. Due to the nature of digital and time-based services, returns are generally not applicable, and refunds are limited as described below.


    2. Individual Users (B2C)

    a) Single Sessions & Session Packages

    • Purchased sessions or session packages (e.g., monthly bundles) are non-refundable once used. 
    • Unused sessions within an active package expire at the end of the billing period, unless otherwise stated at purchase. 


    b) Cancellations

    • Users may cancel a scheduled session within the allowed cancellation window shown at booking. 
    • Sessions canceled outside the allowed window or marked as no-shows are not eligible for refunds. 


    c) Exceptional Circumstances

    Refunds may be considered at TrackFit’s discretion in cases such as:

    • Technical issues preventing session access 
    • Instructor unavailability or session cancellation by TrackFit 
    • Duplicate or erroneous charges 

    Approved refunds will be processed back to the original payment method.


    3. Company / Fleet Subscriptions (B2B)

    • Company-based subscriptions and driver packages are governed by the terms agreed upon at purchase or in a separate written agreement. 
    • Partial refunds are generally not provided for unused sessions or mid-cycle cancellations. 
    • In the event of platform-wide service disruption or failure to deliver agreed services, TrackFit may offer: 
      • Account credits, or 
      • Pro-rated refunds, at its discretion 


    4. Instructor-Canceled Sessions

    If a session is canceled by the instructor or TrackFit:

    • The affected session will be credited back to the user’s account, or 
    • Rescheduled at no additional cost 


    5. Subscriptions & Auto-Renewals

    • Subscription plans renew automatically unless canceled before the renewal date. 
    • Users are responsible for managing cancellations prior to renewal. 
    • Charges made after a renewal date are non-refundable. 


    6. Payment Processing

    • All payments are processed through third-party providers (e.g., Stripe). 
    • TrackFit does not control processing times once a refund is initiated. 
    • Refunds, when approved, may take 5–10 business days to appear depending on the payment provider. 


    7. Chargebacks & Disputes

    • Unauthorized or disputed charges should be reported to TrackFit first. 
    • Initiating a chargeback without contacting TrackFit may result in account suspension. 
    • TrackFit reserves the right to dispute chargebacks where services were delivered as agreed. 


    8. No Medical or Performance Guarantees

    TrackFit does not guarantee specific fitness, health, or wellness outcomes. Refunds will not be issued based on:

    • Lack of perceived results 
    • Individual physical limitations 
    • Personal schedule conflicts 


    9. Policy Changes

    TrackFit reserves the right to modify this Return and Refund Policy at any time. Updates will be posted on the Platform, and continued use constitutes acceptance of the revised policy.
